Legal Eagles #1

Basava Premanand was a skeptic and rationalist from Kerala, and organised many tours around the country and in neighbouring countries like Sri Lanka for the promotion of Scientific Thinking and criticism (no solid evidence, but opinion) of "god and religion" and its "unscientific" beliefs.

In 1986, he sued person X under the Y Control Act (1968) (Now abrogated, under Y Control Act (Repeal) Act, (1990) with reference to Section 6 of General Clauses Act, 1857) for creating Y out of thin air, for the creation of Y is only permitted if the people who work with Y approach the Y Regulation Board and are authorised to work or make Y.

This prominent figure in India X was sued for he did not "take permission or was not authorised" by Y Regulation Board to make Y and was hence a violation of the Y Control Act of 1968.

Unfortunately for Premanand, the case was dismissed with the appeal to the higher courts also meeting the same fate, but Premanand vehemently pointed out that --

"The defendant's spiritual ability is not a valid or recognised defence for a prosecution under the letter of the law"
